Terms of Service

Plain-English summary: Use Ace Achievers honestly, don't share your account or copy our lessons, pay for what you've signed up for, and we'll do our best to help your child learn. You can close your account at any time. If you're under 18, a parent or guardian must agree to these terms on your behalf.

1. Who we are

This website (aceachievers.com.au) and the related online learning platform (the "Service") are operated by Ace Achievers Education Pty Ltd (ABN: 72 680 153 860), trading as Ace Achievers ("we", "us", "our"), a company incorporated in Australia. Our registered office is in New South Wales, Australia.

By creating an account, using free starter lessons, purchasing a course, or otherwise using the Service, you ("you", "the User") agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not agree, please do not use the Service.

2. Eligibility & parental consent

The Service is designed for students in Years 4–12 (typically aged 9–18). Because most users are minors:

  • If you are under 18, you must have a parent or legal guardian agree to these Terms on your behalf and supervise your use of the Service.
  • If you are creating an account for a child, you confirm that you are the parent or legal guardian, you accept these Terms on the child's behalf, and you are responsible for all activity on the account.
  • Parents/guardians remain the account holder for billing, refunds, cancellation, and data requests.

3. Accounts

  • One account per child. Keep your email and password confidential — you are responsible for all activity on the account.
  • You must provide accurate information when registering.
  • We may suspend or terminate accounts that violate these Terms, share login credentials, or attempt to access courses they have not purchased.

4. Free starter lessons

We offer free starter lessons for eligible public courses. During starter access:

  • No credit card is required up-front.
  • You can access the first 3 lessons in each public course.
  • AMC Mock Exam starter access includes the first mock exam only.
  • To continue beyond starter lessons or locked mocks, you must purchase the relevant course.
  • If you do not purchase, your account remains but locked content stays locked.

5. Purchases, pricing & refunds

5.1 Pricing

Course prices are shown in Australian dollars (AUD), inclusive of GST where applicable. Prices are per course as one-time payments unless explicitly marked otherwise. We may change prices at any time, but changes will not affect courses you have already purchased.

5.2 Payment

Payments are processed securely by Stripe. We do not store your full card details. By purchasing, you authorise the charge to your nominated payment method.

5.3 Refund policy

  • Try before you buy: every course includes 3 free starter lessons, plus a detailed curriculum outline. Use these to confirm the course suits your child before purchasing.
  • After purchase: we do not offer cash refunds. If a course is not the right fit, email us and — as a goodwill gesture — we may issue course credit toward another course of equal or lower value (you may pay the difference for a higher-priced course). This credit is not a cash refund.
  • Nothing in these Terms excludes consumer guarantees under the ACL that cannot lawfully be excluded. Where our liability arises from failure to comply with a consumer guarantee, our liability is limited (at our option) to re-supplying the course or refunding the price paid.

6. Course access

Once purchased, you have access to the course for 180 days (about six months) from the date of purchase. We refresh our courses regularly, and 180 days comfortably covers the weekly study pattern of the great majority of students. If you need longer, email us and we will help. We will give at least 30 days' notice if we discontinue a course.

7. Acceptable use

You agree not to:

  • Share your account login with anyone outside your immediate household;
  • Copy, download, screenshot in bulk, redistribute, sell, or republish course content;
  • Use the Service to upload abusive, illegal, or infringing material;
  • Attempt to bypass starter lesson locks, scrape the platform, or reverse-engineer our software;
  • Impersonate another student or misrepresent your child's identity for competition entries.

Breach of this section may result in account termination without refund.

8. Intellectual property

All course content (lessons, problems, mock exams, hint systems, written explanations, video, audio, designs, and software) is owned by Ace Achievers Education Pty Ltd or our licensors and is protected by Australian and international copyright law.

We grant you a limited, personal, non-transferable licence to access purchased content for the User's individual learning. Any other use is prohibited.

9. User-generated content

If you submit essays, answers, or other work to the Service, you keep ownership of your work but grant us a non-exclusive licence to store, process, and display it back to you so we can deliver the Service (e.g. show your progress, provide feedback). We will not use student work to train AI models, and we will not publish identifiable student work without explicit consent.

10. Third-party services

The Service uses third-party providers including but not limited to: Supabase (authentication & database), Stripe (payments), Vercel (hosting), and Google Fonts. Their terms and privacy practices apply to data they process. See our Privacy Policy for details.

11. Disclaimers

The Service is provided "as is". We do not guarantee specific competition results, exam scores, or selection outcomes. Practice and learning depend on student effort.

To the maximum extent permitted by law, we exclude all implied warranties not covered by the Australian Consumer Law.

12. Limitation of liability

Subject to the Australian Consumer Law, our total liability to you in connection with the Service is limited to the amount you paid us in the 12 months preceding the claim. We are not liable for indirect, consequential, or incidental loss (including loss of profits, loss of data, or loss of opportunity).

Nothing in clauses 11 or 12 (or anywhere else in these Terms) limits, excludes or modifies any consumer guarantee, right or remedy under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) that cannot lawfully be excluded. Where our liability arises from a failure to comply with a consumer guarantee that cannot be excluded, our liability is limited (at our option) to re-supplying the Service or refunding the price paid.

13. Termination

  • By you: close your account anytime from your dashboard or by emailing us.
  • By us: we may suspend or terminate accounts that breach these Terms, with or without notice. Refunds in this case are at our discretion.

14. Changes to these Terms

We may update these Terms from time to time. Material changes will be notified by email or by a notice on the Service at least 14 days before they take effect. Continued use after the effective date constitutes acceptance.

15. Governing law & disputes

These Terms are governed by the laws of New South Wales, Australia. Any dispute that cannot be resolved by good-faith discussion will be subject to the exclusive jurisdiction of the courts of New South Wales. Nothing in this clause prevents you from making a complaint to the Australian Competition and Consumer Commission (ACCC) or the NSW Fair Trading.
